MOUNT JEWETT MAN SENTENCED FOR TRYING TO PHOTOGRAPH MAN IN BATHROOM – LEAVING NOTE FOR TEEN

District Attorney Stephanie Vettenburg-Shaffer reports that the Mount Jewett man who pled guilty to trying to photograph an 18 year old man in a bathroom stall and leaving a note on the vehicle of a 17 year old male suggesting sexual contact has been sentenced by a judge at a hearing held June 30th at the McKean County Courthouse. Junior RAINEY pled guilty to Attempted Invasion of Privacy and Corruption of Minors for the crimes that occurred at Walmart in April, 2024. Video surveillance captured RAINEY approaching a vehicle driven by a 17 year old male after the male entered the store and left the vehicle parked in the parking lot. When the 17 year old returned to the car after shopping, he found a note that said, ‘Text if you want (oral sex)” and that listed RAINEY’S telephone number.
Inside Walmart on the same day, video showed RAINEY entering and exiting bathrooms in the front and the back of the store where he was caught by an 18 year old Walmart employee trying to photograph or video record him over a bathroom stall while the 18 year old was using the stall. RAINEY was previously convicted of Invasion of Privacy for similar behavior at a convenience store in Elk County and he was previously ordered to register as a sex offender. District Attorney Stephanie Vettenburg-Shaffer said: “Prior to sentencing, a hearing was held to determine if RAINEY meets the statutory criteria to be classified as a sexually violent predator under Pennsylvania’s version of Megan’s Law which has very specific requirements. Offenders convicted of sex offenses are required to undergo an assessment to determine if the experts find that they meet the criteria set forth in the Act which includes things such as whether the offender has prior sex offenses. Those designated as Sexually Violent Predators must register as sex offenders for their lifetime, report to the State Police to update their information more frequently, and undergo additional counseling requirements.
Following hearing and testimony of an expert with the Sexual Offender Assessment Board, the judge agreed that RAINEY meets the criteria and he will have to register for his lifetime as a sexually violent predator. The judge sentenced RAINEY to a period of state incarceration of 1 year to 2 years plus 3 years of consecutive probation which the judge noted is higher than the standard guideline range set by the legislature but appropriate given the circumstances and was recommended to him given the prior offense. He is not eligible for early parole programs. He is to have no contact with the victims and undergo additional terms.
