STATE ENVIRONMENTAL QUALITY REVIEW ACT TYPE II RESOLUTION REGARDING ALLEGANY COUNTY CONFLICT DEFENDER OFFICE BUILDING RENOVATION Offered by: Public Works Committee
WHEREAS, Allegany County (hereinafter the “County”) proposes to renovate the parsonage house located at 12 Willets Avenue, Belmont, New York, to serve as law offices for the Allegany County Conflict Defender (collectively, the “Project”); and
WHEREAS, in accordance with the State Environmental Quality Review Act (“SEQRA”), the County is required to assess impacts to the environment in compliance with SEQRA regulations included in 6 NYCRR Part 617 (Title 6 of the New York Code of Rules and Regulations); and WHEREAS, the County is the appropriate agency to be the lead agency to undertake the project review under SEQRA; and
WHEREAS, 6 NYCRR § 617.5 under SEQRA provides that certain actions identified in subdivision (c) of that section are Type II actions and not subject to environmental review under SEQRA, and that such activities include “maintenance or repair involving no substantial changes in an existing structure or facility” (§ 617.5(c)(1)), “replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same site,” and “reuse of a residential or commercial structure where the residential or commercial use is a permitted use under the applicable zoning law or ordinance and the action does not meet or exceeds any of the thresholds in section 617.4” (§ 617.5(c)(18)); and
WHEREAS, the proposed improvements consist solely of general renovations to the parsonage house located at 12 Willets Avenue, Belmont, New York, for the purpose of converting the house to law offices. Renovations includes replacement of floor and ceiling finishes, replacement of doors and windows, construction of ADA toilet room and exterior ADA ramp/stair with roof, interior, and exterior painting, and improvements to the HVAC, electrical, and communication systems; now, therefore, be it RESOLVED:
- That the Allegany County Board of Legislators is the lead agency for the SEQRA review of the proposed project.
- That the proposed project is a Type II action, which is not subject to review under SEQRA, and it will not result in a significant adverse impact on the environment.
- That the Allegany County Department of Public Works Superintendent is hereby authorized to sign and file, or have filed, on behalf of Allegany County, all documents necessary to comply with SEQRA. Intro. No. Page 2 of 2 pages
